1. Service Agreement

- Project Scope: Specific deliverables and timelines will be outlined in your individual project proposal or invoice.
- Revisions: Unless otherwise stated, web design packages include a set number of revision rounds. Additional requests beyond the agreed scope will be subject to extra charges.
2. Payment Terms
- Deposits: A non-refundable deposit is required to initiate any design or development project.
- Hosting Fees: Hosting services are billed on a recurring basis (monthly or annually). Failure to pay hosting fees may result in temporary suspension or permanent termination of your website and data.
- Refunds: Due to the digital nature of our work, refunds are generally not provided once work has commenced or after a hosting period has started.
3. Client Responsibilities
To ensure project success, the client agrees to:
- Provide all necessary content (text, images, logos) in a timely manner.
- Ensure they own the legal rights to any materials provided to HostedWebs.
- Maintain the confidentiality of any account login credentials provided for hosting or CMS access.
4. Intellectual Property
- Ownership: Upon full and final payment, ownership of the final visual design and website code is transferred to the client.
- License: HostedWebs retains the right to display the completed project in our portfolio and marketing materials unless a prior Non-Disclosure Agreement (NDA) is signed.
- Pre-existing Material: HostedWebs retains ownership of any proprietary tools, scripts, or base code used across multiple client projects.
5. Hosting & Uptime
While we strive for 99.9% uptime, HostedWebs shall not be held liable for any loss of data, loss of profits, or site downtime caused by:
- Scheduled maintenance.
- Third-party server issues.
- Malicious attacks (DDoS, hacking) beyond our reasonable control.
- Client-side errors or unauthorized modifications to the site code.
6. Termination of Service
We reserve the right to terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including:
- Breach of these Terms.
- Use of our hosting services for illegal activities, spamming, or hosting malicious content.
- Non-payment of service fees.
7. Limitation of Liability
In no event shall HostedWebs, nor its directors or employees, be liable for any indirect, consequential, or special liability arising out of or in any way related to your use of our services or website. Our total liability shall not exceed the amount paid by you for the specific service in question.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which HostedWebs operates, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
